New PD for Legal Assistants in OMHA

Yellow diamond-shaped warning sign, Caution: This workplace protected by NTEUHHS recently notified NTEU that the Office of Medicare Hearings and Appeals (OMHA) has established a new Legal Assistant Position Description (PD) to begin at a GS-0986-5 grade level, with target level of GS-8. According to the notice, the PD was established to provide management with the means to address the need for legal assistants to serve in a hearing or intake capacity. This new PD encompasses the duties of both the legal assistant (hearing clerk) and legal assistant (intake), and provides management with the flexibility to efficiently and swiftly address staffing shortages. The agency’s stated intent is to recruit with and place all incoming Legal Assistants on the new PD. NTEU has requested a briefing to learn more about these new PDs.

I am sharing this information as a reminder that our CBA requires that the agency, including FDA, notifies NTEU of their proposed changes in position descriptions per Article 32, Section 4.
