The FDA has provided Article 3 notice to NTEU that the Office of Regulatory Affairs (ORA) has implemented a standard operating procedure (SOP) for “New Employee Onboarding.” According to the notice, the SOP documents FDA’s existing onboarding practices. The SOP utilizes a checklist to ensure that critical action items are completed in preparation for and during onboarding to facilitate an efficient onboarding experience for the new employee.
According to the agency, the SOP was implemented in February 2017, without notice to NTEU. The agency claims that this was done inadvertently and that it is now attempting to correct the mistake.
As we have learned during several recent briefings, the agency improperly implemented a number of SOPs in anticipation of and pursuant to Program Alignment. To its credit, the agency has provided notice upon discovering these errors and has been working closely with NTEU in order to correct and prevent these ongoing contractual and statutory violations. That said, NTEU is weighing its legal options.
