PMAP Mid-Year Review and Union Representation

This is NTEU CountryArticle 30, Section 7, of the CBA requires that your supervisor documents at least one progress review discussion in person in between the establishment of the performance requirements and the end of the rating period. This is known as the PMAP mid-year review. This Section suggests that the mid-year review is a counseling session if it only covers your accomplishments, performance standards remaining to be accomplished, and training needs.

Article 5, Section 4 B, of the CBA states that you do not have a right to Union representation during counseling sessions with your supervisor.

However, Article 5, Section 4 B, also states that, when a counseling session includes (either in person or via telephone) more than one management official or representative (including labor and employee relations), your supervisor will give you an opportunity to have Union representation present prior to the start of the session.

NTEU Chapter 254 has learned that some supervisors are asking team leads (non-BUE) to join them with the employee in mid-year reviews. In such instances, NTEU deems the team lead a management representative. In such case, Article 5, Section 4 B, allows the employee to request Union representation.

If you rightfully request Union representation, your supervisor may delay the meeting for up to one workday to accommodate this request.
